Adidas and fashion label Thom Browne are back in court to settle their dispute over trademarked striped designs.
In 2021, Thom Browne took legal action against Adidas in London, seeking to invalidate several Adidas trademarks featuring their iconic three stripes logo.
The New York brand claimed that Adidas was attempting to monopolize the use of stripes on clothing, as reported by Reuters.
Adidas is now countersuing Thom Browne for allegedly violating their trademarks by selling sportswear and casual products with four stripes. Adidas accuses Thom Browne of leveraging its brand reputation for personal gain.
As the trial nears its conclusion next week, Thom Browne’s lawyer Philip Roberts accused Adidas of using specific trademarks as “Trojan horses” to prevent other brands from using stripes on their products.
On the other hand, Adidas lawyer Charlotte May argued that Thom Browne’s 2020 expansion into sportswear directly threatened Adidas’ core business.
Last year, Adidas suffered a legal setback when it lost a case against Thom Browne, with the jury ruling that Thom Browne’s use of parallel lines did not infringe on Adidas’ three-stripe trademark or confuse consumers.
In a separate case, Nike also achieved a partial victory over Adidas in a three-stripe trademark dispute during a recent appeal hearing.
